These Terms of Use ("Terms") govern your access to and use of battlebytes.net (the "Site"), operated by Akiva Solutions. By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Who we are and what we are not
BattleBytes is an independent publication that monitors armed conflicts using open information. We are not affiliated with, endorsed by or funded by any government, armed force, armed group, political party or intelligence service. Names of states, armed forces, groups, companies and products appear on the Site only for identification, reporting and commentary.
2. License to use the Site
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial reading and research, subject to these Terms.
Automated access to the machine-readable files we deliberately publish (the JSON and GeoJSON files under /data/ and /live/, Markdown mirrors, feeds and llms.txt) is permitted at reasonable request rates, as described on our For Agents page. You may not overload the Site, scrape it in a way that degrades service, or attempt unauthorized access.
Our derived control layers at /data/control/ are released under the Creative Commons Attribution-ShareAlike 4.0 license and may be reused under its terms. Third-party material we display remains under its owners' licenses; see Attributions.
3. Not for operational use
Maps, positions, event pins, aircraft tracks and analysis on the Site are compiled from public reporting and open datasets. They are incomplete, can be wrong, and are deliberately delayed (see Methodology). Nothing on the Site may be used for military, security, targeting, navigation, travel-safety, evacuation or other operational decisions. If your safety depends on current information, follow official guidance from the authorities and humanitarian organizations responsible for the area.
4. Content disclaimer
News, maps, guides and commentary are provided for general information only. We aim for accuracy but do not guarantee completeness, timeliness or fitness for any purpose. Situations in armed conflicts change quickly, and claims made by parties to a conflict are reported as claims, not as established fact.
No professional advice. Nothing on the Site is legal, financial, investment, security or safety advice.
5. User conduct
You agree not to use the Site to violate any law, infringe anyone's rights, incite or facilitate violence, distribute malware, or interfere with the Site's operation.
6. Intellectual property
The Site's design, original text, code, symbol set and branding are owned by Akiva Solutions or its licensors, except where a page or file states another license. If you believe content on the Site infringes your copyright, see our DMCA Policy.
7. Advertising and affiliates
The Site currently displays no advertising and contains no affiliate links. If that changes, it will be disclosed as described in our Affiliate & Advertising Disclosure.
8. Third-party content and links
Embedded videos and posts load only when you click them and are provided by their respective services under those services' terms. Links to third-party sites are provided for reference. We do not control and are not responsible for third-party sites, services or content, including graphic material that may appear in third-party footage.
9. Disclaimer of warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AKIVA SOLUTIONS AND THE OPERATORS OF BATTLEBYTES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF OR RELIANCE ON THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
11. Indemnity
You agree to defend, indemnify and hold harmless Akiva Solutions and the operators of BattleBytes from claims, damages, losses and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.
12. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law rules, except where prohibited. You agree to exclusive jurisdiction and venue in state or federal courts located in Texas, except where arbitration or small-claims options apply by law. To the extent permitted by law, disputes must be brought in an individual capacity only, not as a class action.
13. Changes and termination
We may update these Terms by posting a new version on this page with a new "Last updated" date. Continued use after changes constitutes acceptance. We may suspend or end access to the Site at any time.
14. Miscellaneous
If any provision is unenforceable, the remainder stays in effect. These Terms are the entire agreement regarding the Site. Our failure to enforce a provision is not a waiver.
